Agreement to these terms

These Terms of Service govern your access to and use of drink1992.com and any purchase you make through it. The site is operated by 1992 Legacy Inc.

By using this site or placing an order you agree to these terms. If you do not agree, do not use the site.

Eligibility and age

You must be 21 years of age or older to use this site or purchase our products. By using the site you represent that you are.

We may require age confirmation before entry and at delivery. We will cancel any order we believe was placed by someone under 21, and we will not ship to anyone under 21 under any circumstances.

Our products

Our products contain hemp-derived Delta-9 THC at or below 0.3% by dry weight, consistent with the 2018 Farm Bill.

They are not intended to diagnose, treat, cure or prevent any disease, and none of the statements on this site have been evaluated by the FDA.

Do not use these products if you are pregnant or nursing, if you have a medical condition, or if you take prescription medication, without speaking to a physician first. Do not drive or operate machinery after use. These products may cause a positive result on a drug test.

Where we can sell

You are responsible for knowing whether our products are legal where you live. You may not order to a state or jurisdiction where hemp-derived THC products are restricted.

We maintain a list of states we cannot ship to and we will cancel and refund orders placed to those addresses.

Orders, pricing and payment

All orders are offers to buy and are subject to our acceptance. We may refuse or cancel any order, including for suspected fraud, pricing errors, quantity limits, or where we cannot lawfully ship.

Prices are in US dollars and may change without notice. We try to keep the site accurate, but if a product is listed at an incorrect price we may cancel the order and refund you in full.

You are responsible for any applicable taxes, which are calculated at checkout.

Subscriptions and recurring billing

If you choose a subscription, you authorise us and our payment processor to charge your payment method on the recurring schedule you select, at the then-current subscription price, until you cancel.

You can skip, pause, change or cancel at any time from your account. Changes take effect for orders not yet billed. Cancelling does not refund an order that has already been billed and shipped.

Shipping and risk of loss

Title and risk of loss pass to you when the carrier takes possession of the package. Our Shipping policy and Return policy set out how we handle damaged, late and undeliverable orders.

Returns

We do not accept returns or exchanges on consumable products. Our Return policy explains the exceptions for damaged, incorrect or incomplete orders, and forms part of these terms.

Accounts

You are responsible for the accuracy of the information in your account and for keeping your credentials secure. Tell us immediately if you believe your account has been used without your permission.

Acceptable use

Do not use this site to break the law, to resell our products without written authorisation, to scrape or copy the site, to interfere with its operation or security, or to misrepresent who you are or how old you are.

Intellectual property

The 1992 name, logo, packaging, photography, copy and site design are owned by 1992 Legacy Inc. and protected by intellectual property law. You may not use them without our written permission.

Content you submit

If you post a review, photo, comment or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display and reproduce it in connection with our business.

You confirm the content is yours to give and does not infringe anyone else’s rights. We may remove content at our discretion.

Disclaimers

The site and the products are provided on an as-is and as-available basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, 1992 Legacy Inc. and its officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or our products.

Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Indemnification

You agree to indemnify and hold harmless 1992 Legacy Inc. from any claim or demand arising out of your breach of these terms, your misuse of the site, or your violation of any law or third-party right.

Governing law and disputes

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Changes to these terms

We may update these terms. The version posted on this page at the time you place an order is the one that applies to that order. Material changes will be noted by the last-updated date above.
